Who these terms are with
These terms are an agreement between you and CommunitEze LLC, a Virginia limited liability company. By creating an account or using CommunitEze, you agree to them. If you use CommunitEze for an association, a landlord business or a management company, you confirm that you're authorized to accept these terms for it.
What CommunitEze is
CommunitEze is software. It records, calculates and notifies; it does not act for an association. The board makes every decision: what to charge, whom to fine, when to send a notice. CommunitEze records those decisions and delivers what the board approves. CommunitEze is not a community association manager, does not hold association funds, and is licensed to you as software, not engaged as a management service.
Money
Payments are processed by Stripe under Stripe's terms. Dues are paid to the association's own connected account and rent to the landlord's; CommunitEze never takes custody. Processing fees are Stripe's published rates, passed through without markup. Subscription fees for CommunitEze itself are billed as described on the pricing page.
Stripe requires every association and landlord that collects money to have a public web page. If you have none, you may ask us to publish a short profile page about you on communiteze.com. It shows the name, city and state you gave us and what you collect, with the same short explanation every profile page carries of how paying, refunds, disputes, autopay and contact work. It is published only after you confirm it, and it stays up while your Stripe account relies on it. You are responsible for its accuracy; it is your statement, published at your request.
Your records
An association's records belong to the association; a landlord's to the landlord; your payment history to you. You may export them at any time. When you leave, you keep your own records and lose access to everyone else's.
Accounts
One person, one account, whatever they hold — except that management-company staff use a work account that carries only the company's work. Keep your sign-in email secure; a sign-in link or code is the key to your account.
Availability and changes
We aim for the service to be available at all times and will tell you about planned interruptions. We may change these terms and will notify account holders by email at least thirty days before a change takes effect.
Your decisions and your responsibilities
You decide what to charge, when to charge it, which notices to send and whom to fine. CommunitEze doesn't make those decisions, doesn't interpret your governing documents or the law, and doesn't give legal, tax or accounting advice. You're responsible for making sure your charges, fees, notices and records follow your governing documents, your leases and the law that applies to you, and for the accuracy of what you enter.
Your data and privacy
We use the personal information in your records only to provide CommunitEze, as our privacy policy describes. You're responsible for having the right to put that information into CommunitEze and for telling the people in your records how it's used, where the law requires it. We protect it with reasonable safeguards, and we'll tell you without undue delay if a security incident affects your records.
Content you post
You're responsible for what you post in CommunitEze. You keep your rights to it, and you give CommunitEze LLC permission to store it and show it to the people it's meant for, only so the service can work. Don't post anything that our Content and copyright page says isn't allowed. We may remove content that breaks those rules or the law, following the process on that page, and a board may remove posts in its own community.
Services from other companies
Stripe processes payments, and other companies provide parts of the service, each under its own terms. We aren't responsible for their services, and their terms apply when you use them.
No warranties
CommunitEze is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the service will be uninterrupted or error-free, or that calculations, reminders or notices will be complete or correct for your circumstances.
Check what matters before you rely on it.
If the service doesn't work as described
Tell us at support@communiteze.com. We'll try to fix it. If we can't within a reasonable time, you may cancel, and we'll refund any subscription fees you prepaid for the time after you cancel. That is your only remedy when the service doesn't perform as described.
Limits on liability
To the extent the law allows, neither you nor we are liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible. Our total liability for all claims relating to CommunitEze is limited to the greater of the fees you paid us in the 12 months before the claim arose or $100. These limits don't apply to your obligations under "Holding us harmless" or to amounts you owe us.
Holding us harmless
You'll defend, indemnify and hold harmless CommunitEze LLC and its members from claims, losses and costs, including reasonable attorneys' fees, that arise from the decisions you make and the actions you take using CommunitEze, including the charges, fees, fines and notices you issue; from your breach of these terms; or from your violation of the law or of anyone's rights. If you use CommunitEze only to see and pay what you owe, this section applies only to your own misuse of the service.
Law and disputes
Virginia law governs these terms, without regard to its conflict-of-laws rules. Send any legal notice to legal@communiteze.com. Any dispute will be decided in the state or federal courts located in Virginia, and you and we consent to their jurisdiction.
